1. LEGALLY BINDING AGREEMENT
By accessing, ordering from, or using any services provided by MATTALABS Foods Private Limited, including through our brand Taste of Guardians, whether via online platforms, mobile apps, offline channels, third-party delivery apps (like Zomato, Swiggy, etc.), or in-person, you hereby irrevocably agree to be bound by these Terms & Conditions in full. These terms constitute a legally binding contract between you (the customer) and MATTALABS Foods Private Limited.
IF YOU DO NOT AGREE, you must not place an order or use any services offered by MATTALABS Foods Private Limited.
2. ORDER ACCEPTANCE, REJECTION & CANCELLATION RIGHTS
- All orders placed are subject to acceptance by MATTALABS Foods Private Limited. We reserve the sole and absolute right to accept, reject, cancel, or modify any order at any time, for any reason, without notice or liability.
- Orders are considered offers to purchase, and no order is confirmed until explicitly accepted by MATTALABS Foods Private Limited through order confirmation or fulfillment.
- We reserve the right to block or ban customers who violate these Terms, abuse the system, or engage in fraudulent behavior.
3. STRICT NO CUSTOMIZATION POLICY
- MATTALABS Foods Private Limited follows standardized recipes and processes. We do not offer any customizations, alterations, or substitutions under any circumstances.
- Special instructions added via order notes or third-party apps will be ignored and have no binding effect on how we prepare your food.
4. FOOD ALLERGIES, SENSITIVITIES & CUSTOMER RISK
- Food prepared by MATTALABS Foods Private Limited may contain or come into contact with the following allergens:
Nuts, dairy, wheat/gluten, soy, sesame, eggs, mustard, seafood, artificial colors, food preservatives, and spices.
- We do not guarantee allergen-free, vegan, or gluten-free food, unless explicitly stated on packaging or official menus.
- It is the sole responsibility of the customer to verify food suitability for their dietary needs before placing an order.
- MATTALABS Foods Private Limited is not responsible or liable for any allergic reactions, food-related illnesses, or health complications arising from consumption of our products.
⚠️ ALLERGY WARNING: Customers with known allergies or dietary restrictions must refrain from ordering. Orders are placed entirely at your own risk.
5. PRICING, PAYMENTS & PROMOTIONS
- All prices are final, non-negotiable, and may be inclusive or exclusive of applicable taxes, as specified.
- MATTALABS Foods Private Limited reserves the right to modify, update, or revoke any promotional offer, discount, or coupon at any time without notice.
- Full payment is required before processing orders.
- We may refuse, cancel, or delay any transaction involving suspicious, disputed, fraudulent, or failed payments.
6. REFUND, RETURN & EXCHANGE POLICY
⚠️ ALL SALES MADE TO CUSTOMERS BY MATTALABS FOODS PRIVATE LIMITED ARE STRICTLY FINAL.
No refunds, cancellations, returns, exchanges, replacements, or credits will be issued, for any reason, including but not limited to:
- Dissatisfaction with taste or portion
- Delivery delays caused by third-party logistics
- Change of mind or unavailability at time of delivery
- Incorrect address or contact information
- Incorrect order selection by customer
By placing an order, you unconditionally waive all rights to refunds or compensation of any kind.
7. DELIVERY, THIRD-PARTY LIABILITY & TRANSFER OF RISK
Delivery times provided by MATTALABS Foods Private Limited or third-party partners are estimates only and not guaranteed.
We are not liable for any issues arising from:
- Delivery partner errors or delays
- Customer unavailability or wrong contact details
- Weather, traffic, or technical failures
Risk of loss, damage, or spoilage passes to the customer as soon as the order is handed over to the delivery partner or customer representative.
8. ORDER INSPECTION & ISSUE REPORTING
- Customers must immediately inspect all food items upon delivery.
- Any issues, missing items, or visible damage must be reported within 1 hour of delivery time via our official customer support channel.
- Failure to report issues within the specified window shall be deemed full acceptance of the order as-is. No claims will be entertained thereafter.
9. INTELLECTUAL PROPERTY OWNERSHIP
- All content, menus, logos, product names, packaging designs, recipes, and related materials are the exclusive property of MATTALABS Foods Private Limited.
- Unauthorized use, reproduction, sale, or distribution of our intellectual property is strictly prohibited and will result in civil and/or criminal legal action.
10. FRAUD PREVENTION, MISUSE & TERMINATION
MATTALABS Foods Private Limited reserves the right to:
- Refuse or cancel service to any individual
- Report suspicious activity or fraudulent behavior to authorities
- Permanently block access to users found misusing the platform, exploiting refund systems, or breaching these Terms
False claims, fake allergy complaints, or fraudulent disputes will result in immediate account blacklisting and potential legal consequences.
11. CHANGES TO TERMS, SERVICES OR POLICIES
- MATTALABS Foods Private Limited may modify these Terms & Conditions, service features, menu offerings, pricing, and policies at any time, without prior notice.
- Continued usage of our services following any change constitutes automatic and binding acceptance of the revised Terms.
12. LIABILITY LIMITATION & CUSTOMER INDEMNIFICATION
To the maximum extent permitted by applicable law, MATTALABS Foods Private Limited disclaims all warranties, express or implied, including but not limited to:
- Taste satisfaction
- Nutritional outcomes
- Food quality beyond dispatch
We are not liable for any damages, including but not limited to:
- Allergic reactions
- Health conditions or injuries
- Delivery mishaps
- Emotional distress
- Lost business or consequential loss
You agree to fully indemnify, defend, and hold harmless MATTALABS Foods Private Limited, its directors, employees, and partners from any claims, legal proceedings, costs, or liabilities arising from your misuse of our services or violation of these Terms.
13. GOVERNING LAW & JURISDICTION
- These Terms shall be governed by the laws of India.
- Any disputes arising from use of MATTALABS Foods Private Limited’s services shall be subject exclusively to the jurisdiction of courts located in Bengaluru, Karnataka.
- Customers expressly waive any rights to class action lawsuits or collective proceedings.
14. AUTOMATIC ACCEPTANCE & LEGAL VALIDITY
By placing an order, making a payment, or using our service — whether online, in-store, or through third-party apps — you confirm that you have read, understood, and unconditionally accepted these Terms & Conditions.
You also waive all rights to challenge these Terms on the basis of not reading or receiving them
